1. Platform Overview

Ventoro Trips ("we", "us", "the Platform") is an online marketplace that connects tourists and visitors with local tour operators and experience providers ("Partners") in the Istria region and broader Croatian coast. We facilitate the discovery, booking, and payment for local trips, tours, and activities. Ventoro Trips acts solely as an intermediary technology platform that enables customers to discover and book experiences offered by independent Partners. Ventoro Trips is not a travel agency, tour operator, organizer of package travel, carrier, or direct provider of any experience listed on the Platform.

Each Partner is solely responsible for: (i) the operation and delivery of their experiences, (ii) compliance with applicable laws and regulations, (iii) obtaining all required permits, licenses, and insurance, (iv) accuracy of descriptions, pricing, and availability, (v) health and safety standards applicable to their activities. Ventoro Trips does not guarantee the accuracy, completeness, or quality of any Partner-provided content or services.

2. Booking Terms

When you book a trip through Ventoro Trips, you enter into a contract with the Partner who provides the experience. Your booking is confirmed once payment has been successfully processed. You will receive an instant email confirmation with all booking details, including the meeting point, time, and any special instructions. Please review your booking confirmation carefully and contact us immediately if anything is incorrect.

3. Electronic Acceptance

By creating an account, completing a booking, clicking "Book Now", "Confirm", or any similar button, or otherwise using the Platform, you acknowledge and agree that such actions constitute a legally binding electronic acceptance of these Terms & Conditions.

4. Payment

All payments are processed securely through Stripe, a PCI-compliant payment processor. We accept all major credit and debit cards. All prices on the Platform are displayed in EUR (€). The total price you see at checkout is the final price - there are no hidden fees for customers. Ventoro Trips charges Partners a commission of 15–20% per completed booking, which is already included in the listed price.

5. Cancellation & Refund Policy

You may cancel your booking free of charge up to 24 hours before the scheduled start time of the experience and receive a full refund. Cancellations made less than 24 hours before the start time are non-refundable. If a Partner cancels the experience (e.g., due to weather or safety concerns), you will receive a full refund or the option to reschedule at no additional cost. Refunds are processed to the original payment method and may take 5–10 business days to appear on your statement.

6. Partner Obligations

Partners listed on Ventoro Trips agree to: provide accurate and truthful descriptions of their experiences, including photos, duration, inclusions, and any physical requirements; arrive on time at the designated meeting point and deliver the experience as described; provide all necessary safety equipment and comply with local regulations and safety standards; hold valid licenses, permits, and insurance required for operating their activities; communicate any changes or cancellations to both Ventoro Trips and the customer in a timely manner.

7. User Responsibilities

As a user of Ventoro Trips, you agree to: provide accurate personal and contact information when making a booking; arrive at the designated meeting point on time - late arrivals may result in forfeiture of the experience without refund; follow the instructions and safety guidelines provided by the Partner and their guides; behave respectfully toward guides, other participants, and the local environment; inform the Partner of any medical conditions, allergies, or physical limitations that may affect your participation.

8. Limitation of Liability

Ventoro Trips operates as a marketplace and booking platform. We are not the provider of the tours, trips, or activities listed on our platform. While we carefully vet our Partners, we do not assume liability for any injury, loss, damage, delay, or dissatisfaction arising from the experiences provided by Partners. We strongly recommend that all travelers carry appropriate travel and health insurance.

To the fullest extent permitted by applicable law, Ventoro Trips shall not be liable for: (i) indirect or consequential damages, (ii) loss of profits, revenue, business opportunity, or reputation, (iii) technical interruptions, system failures, or downtime, (iv) acts or omissions of Partners, (v) inaccurate information provided by Partners, (vi) force majeure events including weather conditions, natural disasters, strikes, governmental actions, or transport disruptions. In any event, the total liability of Ventoro Trips shall not exceed the amount paid by the customer for the relevant booking.

9. Disclaimer of Warranties

The Platform and all services are provided on an "as is" and "as available" basis. Ventoro Trips does not guarantee that: (i) the Platform will always be uninterrupted, secure, or error-free, (ii) bookings will always be available, (iii) the Platform will operate without delays or technical issues. To the fullest extent permitted by law, Ventoro Trips disclaims all warranties, whether express or implied.

10. Force Majeure

Ventoro Trips shall not be responsible for delays, cancellations, failures, or disruptions caused by circumstances beyond its reasonable control, including but not limited to natural disasters, weather conditions, governmental restrictions, war, strikes, pandemics, internet outages, or failures of third-party service providers.

11. User and Partner Content

Ventoro Trips reserves the right to remove, suspend, or modify any content published on the Platform that: (i) violates applicable law, (ii) infringes intellectual property rights, (iii) contains misleading or fraudulent information, (iv) violates these Terms.

12. Intellectual Property

All content on the Ventoro Trips website - including but not limited to text, graphics, logos, images, design elements, and software - is the property of Ventoro Trips or its content providers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this platform without our prior written consent.

13. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Any changes will be posted on this page with an updated effective date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised terms. We encourage you to review this page periodically.

14. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of Croatia. Any disputes arising out of or in connection with these Terms shall be subject to the jurisdiction of the competent courts in Croatia, without prejudice to mandatory consumer protection rights under applicable law.
